WITNESS STATEMENTS AND PROVING LOSS OF EARNINGS

The previous post dealt with the importance of witness statements in proving heads of loss.   An example was given of a failure to prove loss of earnings through inadequate evidence.

LOSS OF EARNINGS ON MY OTHER BLOG

I maintain another Blog  Accidents at Work & Loss of Earnings Claims. I have put a post on that blog on proving loss of earnings with 16 simple questions the witness statement should address in order that a claim for loss of earnings can be more securetly established at trial.

This goes some way to dealing with the kind of problem that the claimant had in  McRae -v- Chase International Express Ltd [2003] EWCA Civ 505, the case considered in detail in the recent  post on witness statements.
